Getting a lawyer doesn’t make you look guilty — magistrates expect it. A conviction isn’t automatic. And the free duty lawyer generally isn’t available for traffic matters.

Where your charge is heard

Most traffic charges start in the Magistrates Court — drink and drug driving, unlicensed, disqualified and careless driving. The serious ones (dangerous driving, evading police) can carry imprisonment and may go to the District Court. The earlier we start, the more options you have.

Your first court date

Your first appearance is a mention, not a trial — nothing is decided that day unless you want it to be. It’s the chance to get advice, ask for time to prepare, and set the matter up properly. With us acting, you usually don’t have to say a word.

Drink & drug driving

Charged under the Transport Operations (Road Use Management) Act. Drink driving runs in three ranges (low, mid and high); drug driving covers a relevant drug present or driving under the influence. Each carries a mandatory disqualification — how long is what we argue down.

Unlicensed & disqualified

Driving unlicensed, or while disqualified or suspended, ranges from a simple oversight to a charge carrying a mandatory further disqualification and, for repeat matters, the real prospect of prison. Which one you’re facing turns on the detail — get advice before you plead.

Dangerous & careless driving

Careless driving (driving without due care) is the everyday charge — usually a fine and points. Dangerous operation of a vehicle is far more serious, can carry imprisonment, and where someone is hurt or killed is dealt with in a higher court. We often negotiate dangerous down to careless on the evidence.

Evading police

Failing to stop for police carries a heavy mandatory minimum — a large fine or 50 days in prison, and a two-year disqualification. It’s one of the most serious traffic charges in Queensland, so how the facts are presented and case-conferenced matters enormously.

Pleading guilty or not guilty

You don’t have to decide at your first mention. We read the QP9 and the evidence first, tell you honestly whether the charge can be defended or negotiated, and only then help you decide how to plead — never the other way around.

Special hardship order

If your licence is suspended for demerit points on a good behaviour period, or a 40km/h+ speeding offence, a special hardship order can keep you driving for work and essentials. It can be applied for at any time — the sooner the better.

Will a conviction be recorded?

Not automatically. For traffic offences the magistrate has a discretion, weighing your age, history and the impact on your job and travel. We argue against recording a conviction in every matter where it’s realistic — often the most valuable thing won on the day.

Getting your licence back

A disqualification doesn’t end with you simply driving again — you reapply through Transport and Main Roads, and for drink and drug matters may need to fit an alcohol interlock for a period. We make sure you know your eligibility date and the steps.

Why start early

Most matters run 3–6 weeks from charge to sentence — just enough time to complete QTOP, gather references and prepare properly. The people who get the best outcomes are the ones who called the week they were charged, not the night before court.

Queensland has two ways to keep driving when your licence is on the line — a work licence if you’re convicted of drink or drug driving, and a special hardship order if you’re suspended for demerit points or high speed. Where is the court?

Brisbane Magistrates Court is at 363 George Street, in the CBD — 26 courtrooms across several levels. Your Notice to Appear may instead name Holland Park, Sandgate, Wynnum or Richlands; we appear at all of them.

Where do I park?

There is no public parking at the court. Use a CBD carpark (King George Square, Myer Centre or nearby), or take the train — Roma Street and Central stations are both a short walk. Allow time and money for either.

What time do I need to be there?

Most matters are listed at 8:30 or 9:00am. Arrive by 8:30am — the security queue at a court this size takes time, and you need to find your courtroom before the magistrate sits.

What days does the court sit?

Brisbane Magistrates Court sits Monday to Friday, with many courtrooms running each day. Your listing day is printed on your Notice to Appear — we confirm it when we take your matter on.

How do I check my court date?

It’s printed on your Notice to Appear or bail undertaking. Lost it? Use the Queensland Courts criminal case lookup online, ring the registry — or call us and we’ll check it for you the same day.

How do I find my courtroom?

Check the daily law list — published online at 6:45am and updated at 8:45am each court day — or the display boards in the foyer. If we act for you, we text you the courtroom that morning

What is the daily law list?

The court’s running order for the day: every person appearing, their courtroom number and time. Your name appears on it on the day of court only, then it comes down.

Is there security at the entrance?

Yes — everyone entering is screened, airport-style. Allow ten minutes, dress neatly (no thongs or singlets), and leave anything sharp at home. Phones are fine, but must be silent inside the courtroom.

Can I bring someone with me?

Yes — bring a partner, parent or a friend for support. Court is open to the public, so they can sit in the gallery while your matter is heard. It’s best to leave young children at home if you can — waiting times can run long.

Many magistrates sit at Brisbane Magistrates Court, allocated to courtrooms day by day — you can’t choose who hears your matter, and neither can we. What we can do is know them: our lawyers appear before Brisbane’s magistrates every week, and we know what each gives credit for and what they expect to hear. 01 Your first court date is a "mention"

A short administrative appearance. The prosecutor hands over the QP9 — the police version of events, with any certificates and your traffic history attached. Nothing is decided unless you choose to plead that day.

02 You have three options

Plead guilty and be sentenced (only wise if you’re fully prepared), adjourn to get advice and preparation time — the most common first step — or plead not guilty, and the court orders a brief of evidence and sets a hearing date.

03 Pleading guilty? Sentencing is usually the same morning

The prosecutor reads the facts, hands up your history, and then it’s your side’s turn — your lawyer puts your circumstances, your references and any course completion to the magistrate, and asks for the penalty to sit at the low end.

04 Pleading not guilty? The matter is adjourned for a hearing

The prosecution must disclose its evidence, and a hearing date is set — usually some months away. We’ll give you an honest view of your prospects before you commit to that path.

05 After it's decided

The order takes effect immediately: disqualification dates, fine (payable through SPER on a plan if needed), and any licence steps. We walk you through all of it outside — and if the outcome is genuinely wrong, an appeal to the District Court must be filed within 28 days.

An independent police prosecutor — not your arresting officer — runs the case against you.

A free court lawyer for people at risk of jail — generally not available for traffic matters.

Conviction recorded / not recorded

The court can decide not to record a conviction — it still counts as a penalty, but doesn’t show on standard checks.

Disqualification

The period you cannot drive, set by the magistrate. It starts the moment you’re sentenced.

SPER

The state agency that collects court fines — payment plans are available, so the fine never has to be paid on the day.

Do I need a lawyer for a traffic charge in Jindalee?

How long will my matter take?

Your court morning is usually done before lunch — your matter itself takes 10–15 minutes. Start to finish, most pleas run 3–6 weeks from charge to sentence, which is exactly the time we use for QTOP and references.

Can I keep driving until my court date?

It depends on the charge. Mid and high range drink driving triggers an immediate suspension; low range usually means a 24-hour suspension then you can drive until court. Read us your paperwork and we’ll tell you exactly where you stand — getting this wrong is a disqualified driving charge.

What happens at my first court date?

It’s a “mention” — a short administrative appearance. You (or your lawyer) can plead guilty and be sentenced that morning, adjourn to prepare, or plead not guilty and get a hearing date. Represented matters are generally called first.

Won't getting a lawyer make it look worse?

The opposite — magistrates see representation as taking the charge seriously. Remember, in court only your lawyer is on your side: the magistrate and the police prosecutor are not.
