The honest picture

What a disqualified driving charge in Queensland actually means

Disqualified driving is charged under section 78 of the Transport Operations (Road Use Management) Act — it means driving while a court order still disqualifies you. Magistrates treat it as disobeying their own order, which is why it’s so serious. Six things are worth knowing before your court date:

It's the traffic charge most likely to mean jail

Disqualified driving is the leading traffic offence that sends people to prison in Queensland — about 1 in 10 charged receive a prison sentence. Magistrates take it personally: you drove after a court told you not to.

It's different from ordinary unlicensed driving

The charge only applies where a court disqualified you and that disqualification was still in force when you drove. That’s what makes it far more serious than driving on an expired or never-held licence.

Prison is on the table — especially if it's not your first

First-timers are generally not jailed, but it’s a real risk. If you have a prior disqualified driving charge or a bad traffic history, specific submissions are needed to keep you out of jail — community service or a suspended sentence instead.

No work licence — minimising the disqualification is everything

You cannot apply for a work licence, special hardship licence or any authorisation to drive if found guilty. A further disqualification of 2 to 5 years is mandatory — so keeping it to the 2-year minimum is the whole game.

The 2-year minimum is often misunderstood

People confuse it with New South Wales, where it’s 1 year. In Queensland the minimum further disqualification is 2 years, up to 5. And a section 10 “no conviction” dismissal is a NSW thing — it does not exist here.

There are genuine defences — and we've run them

Necessity or emergency (driving someone for urgent medical care), you weren’t on a road, the disqualification had actually ended, or duress. We’re one of very few firms to have had disqualified driving charges dropped entirely on these grounds.
