What a disqualified driving charge in Queensland actually means
Disqualified driving is charged under section 78 of the Transport Operations (Road Use Management) Act — it means driving while a court order still disqualifies you. Magistrates treat it as disobeying their own order, which is why it’s so serious. Six things are worth knowing before your court date:
1
It's the traffic charge most likely to mean jail
2
It's different from ordinary unlicensed driving
3
Prison is on the table — especially if it's not your first
4
No work licence — minimising the disqualification is everything
5
The 2-year minimum is often misunderstood
6
There are genuine defences — and we've run them
Penalties at a glance
Lower end
Fine + 2-year disqualification
2 years is the minimum further disqualification in Queensland · no work or hardship licence · more likely for a genuine first offence with good mitigation
Higher end
Prison + up to 5-year disqualification
Jail (generally under 6 months but life-changing) · up to 5-year disqualification · far more likely with prior disqualified driving, a bad history, or other charges at the same time.
