The three ranges

Low, mid or high range — which charge are you facing?

Queensland charges drink driving in three bands, all under section 79 of the Transport Operations (Road Use Management) Act . Your blood or breath alcohol reading decides the band — and the band decides the mandatory minimum disqualification, whether you can apply for a work licence, and how serious the court treats it. Every band still leaves plenty to argue at court.

The most common drink driving charge. Serious, but the most workable — with the lowest mandatory penalties of the three.

Low range is 0.05–0.099, mid range 0.10–0.149, high range 0.15 and above. A work licence is only possible under 0.15 — at high range there is none.

Will I lose my licence?
Yes — a disqualification is mandatory for every band: at least 1 month at low range, 3 at mid range, 6 at high range. How far past the minimum yours goes is decided at court, which is where preparation earns its keep.
Not automatically. For traffic offences the magistrate has a discretion, weighing your age, history and the impact on your job and travel. We argue against a recorded conviction in every matter where it’s realistic — it’s often the most valuable thing won on the day.

No — drink driving carries a disqualification and fine, not demerit points. You also can’t plead guilty online; every drink driving matter is dealt with in person, in open court.
Can I still drive for work?
If your reading was under 0.15 and you qualify, a work licence can keep you driving through the disqualification. It must be applied for before you’re sentenced — so call before your court date. At 0.15 or over, no work licence is available.
This is where a lawyer helps most. The plea is a given — the disqualification length, the fine, the work licence and whether a conviction is recorded are not. Months of driving are decided in the few minutes before the magistrate.
For low and mid range, no. High range carries a maximum of 9 months’ imprisonment, but for a first offence with good preparation jail is rare — a repeat high range within 5 years is the real risk. Either way, it’s not a charge to face unprepared.
Refusing to provide a specimen of breath or blood is treated just as seriously as a high range reading — same disqualification range, no work licence. Call us; there’s often more to the circumstances than it first appears.
